Digital Government Act (Wdo) adopted

Digital Government Act (Wdo) adopted

by Erik Bouwer
March 22 2023

On March 21, the Dutch Senate passed the digital government bill. The Digital Government Act (Wdo) will enter into force in phases on 1 July 2023. Among other things, the law provides that public service providers have more certainty about the identity of citizens and that citizens can use different means of login.

This law is the first part ('tranche') of the regulations for the further digitization of the government. The first tranche is about how citizens and companies can log in safely and reliably to the (semi-)government. Citizens will be given the opportunity to use private login means in addition to DigiD. In addition, the law contains rules on information security and privacy and the application of open standards.

The law obliges public service providers to determine per service what assurance level is required for access to their digital services. They are also obliged to accept the means of login authorized by the Minister of the Interior and Kingdom Relations for their digital services. For admission, providers of these login tools must continue to meet admission requirements. This applies to the public login tool DigiD and private tools such as eHerkenning, but also to possible new private login tools for citizens and companies.

More certainty about identity and more means of login

These changes provide a number of benefits. These identifiers give public service providers more certainty about someone's identity. Citizens' data is also better protected. In addition, citizens and companies will soon have a choice of several means of logging in.

Public service providers must comply with the obligations in the Wdo as soon as they are connected. The connection will take place in consultation with the service providers in the near future, so that feasibility can be taken into account.
